2010 TAB Sportsbet National Tipping Competition

1. General Entry
Information on how to enter and prizes form part of these conditions of entry ("Conditions of Entry"). By entering or participating in the 2010 TAB Sportsbet National Tipping Competition ("Competition"), each participant fully and unconditionally agrees and acknowledges that these terms and conditions and the decision of the Promoter on all matters relating to this Competition are final and binding.

Entry is open to all residents of Australia aged 18 years and over ("Participants"). Participants may enter once for both AFL and NRL competitions. Participants may enter for free at all NSW and VIC TAB agencies. Participants entering online must have a TAB Sportsbet account.

Directors, Officers and Employees of, or contractors to, the TABCORP group of companies, their immediate families and all TABCORP agencies and companies associated with this Competition may not enter the Competition and will be not be eligible to be awarded any prizes.

For the purposes of these Conditions of Entry, "immediate families" means a spouse (including de facto), parent, sibling, child, grandparent, grandchild, or parent in law and includes stepparents and stepchildren and half siblings.

2. Term of Promotion
The competition ("Competition") will run over the 2010 NRL premiership home and away season commencing Friday 12th March 2010 and concluding Sunday 5th September 2010 and the 2010 AFL premiership home and away season commencing Thursday 25th March 2010 and concluding Sunday 29th August 2010. The Competition will not include semis or finals rounds ("Competition Period").

Entry will be from Monday 15th February 2010 at 12:01AM AEST to the beginning of the final regular AFL and NRL season game ("Entry Period").

The Competition will close at 7:25pm AEST on 5th September 2010.

Strictly one entry per person.

3. NRL Tipping Weeks
The Competition will contain 26 separate weeks for entry (the NRL "Tipping Weeks") corresponding to the 26 weeks of matches of the NRL 2010 season, excluding any finals matches (known as the NRL "Regular Season").

4. AFL Tipping Weeks
The Competition will contain 22 separate weeks for entry (the AFL "Tipping Weeks") corresponding to the 22 weeks of matches of the AFL 2010 season, excluding any finals matches (known as the AFL "Regular Season").

5. Tipping Week Deadline
The weeks of matches for the Regular Season are set out on the Tipping pages of the Competition Website. Any postponed, rescheduled or delayed matches will have their match times updated during the season to become part of the next appropriate Tipping Week in which the match will be played.

The deadline for each Tipping Week ("Deadline") will be specified on the "My Tips" page on the Competition Website. Unless otherwise specified, Participants can tip up to the start of each match in every Tipping Week.

Where tips are being entered directly into the website by a Participant, tips can be submitted or changed up until the start of each match. For tips being entered at a TAB venue by venue staff on a Participant's behalf, Participants must provide their tips to venue staff no later than 20 minutes prior to the start of the match or at such earlier time at the discretion of each venue's staff.

6. Registration Process
To enter, Participants must, during the Entry Period, complete the Competition registration form on the TAB Sportsbet 2010 National Tipping Competition website (tab.com.au) (the "Competition Website"), read and agree to be bound by these Conditions of Entry ("Registration").


Participants must select a valid username and password at the time of Registration. Participants must enter their username and password each time they access the Tipping Competition section on the Competition Website.

7. Entry Process
To enter, Participants must complete the Registration process.

During the Competition Period, Participants must select both: a. the winning team or a draw for each match in a Tipping Week before the Deadline for the Tipping Week in question; and b. the difference between the final scores (the "Margin") of their Tipped winning team and the other team playing the nominated match (known as the "Margin Match") in the free text box next to that match before the Deadline for the Tipping Week in question.

The Promoter reserves the right not to accept for registration any Participant if the Registration contains anything slanderous or defamatory or is otherwise unsightly in any way.

The Promoter reserve the right to delete Participants from the Competition if the Promoter reasonably believes that the Participant has breached any of these Conditions of Entry, or that the Participant is in any way causing disruption to the provision of the Competition or the Competition Website.

Any Participant found to be abusing the Competition by entering multiple times for the purpose of submitting multiple possible winning combinations may be removed from the Competition. Participant's caught cheating or hacking the system will be removed immediately and appropriate authorities will be contacted based on the severity of the breach.

The Promoter reserves the right to change the rules or functionality of the system throughout the season if there is a significant reason for this to occur. Participants will be informed of any such changes.

The Promoter makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Competition.

All Participants and Competition winners consent to the publication of their name and suburb of residence (and request that their full address not be published) and agree to participate in reasonable promotional activities as requested by the Promoter.

The Promoter reserves the right to limit the number of Participants in Competition at any time for any reason.

Any entry that fails to provide all required information may be disqualified. The Promoter assumes no responsibility for incomplete, late or misdirected entries, or entries received through impermissible or illegitimate channels or for failed, partial or garbled computer transmissions, or for technical failures of any kind. The Promoter reserves the right to disqualify any Participant submitting an entry which is not made in accordance with the terms of these Conditions of Entry.

The Promoter and its agencies associated with this Competition are not liable and do not accept responsibility for: • Participant's tips that are not received or which are received and subsequently corrupted or rejected by the Competition Website server. • Any lost, misdirected or corrupt emails to or from the Competition Website; • Any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with a Participants participation in the Competition or the taking of a place, except that which cannot be excluded by law; and relating to the conduct of the Competition however caused, including failure of the Competition Website or incorrect or corrupt data supplied by the Promoter to a Participant.

All Competition winners' contact details are retained for administrative purposes and for promotion of future competitions and events within TABCORP or its affiliated companies. See Privacy section below for further details.

8. Selection of Winners
Participants will be awarded points in each Tipping Week as follows;

Non-submission of Margin Prediction Average margin score for the round will be awarded.
The average is based on all of the scores recorded from all participants in a particular round. A margin score is calculated for each round based on the difference between the submitted Margin Prediction and the actual result. For example, if a team is tipped to WIN by 10 points and the actual Result is a WIN by 5 points, the Margin Score awarded will be 5 points. If a team is tipped to WIN by 10 points and the team LOSES by 5 points, the Margin Score awarded is 15 points.
Late Entry during Season The entrant will receive all points from the Away winning teams up to a maximum of 4 points per round already played, and the average Margin Score for each previously completed round.
How we use your Margin Prediction The Margin Prediction is used as a tie-breaker, should more than one entry be ranked equally based on Correct Tips. The cumulative Margin Score for a participant is the total of all Margin Scores awarded for all completed Rounds to date. The lowest Margin Score and Cumulative Margin Score is ranked highest. Ranking of participants from the last Round completed will appear on this website.


The day following the completion of each Tipping Week of matches, the winner(s)' names for the corresponding Tipping Week will appear on the Ladder page of the Tipping Competition section of the Competition Website, and will also be notified by the Promoter via email.

9. Prizes
All prizes awarded are to be collectively referred to as "Prizes". There will be weekly prizes awarded to Participants who successfully tip a Perfect Round ("Weekly Prizes"), see below for further details. There will also be a prizes awarded to the Overall Winners of the NRL and AFL Competition ("Major Prize(s)").

Weekly Prizes If a Participant picks the 8 winners in any Tipping Week during the Competition ("Perfect Round") the Participant will win two (2) tickets to the 2010 AFL or 2010 NRL Grand Final ("Weekly Perfect Round Winner"). If they pick the perfect round in the NRL competition they will receive NRL tickets only. If they pick the perfect round in AFL they receive the AFL Grand Final Tickets only. Airfares and accommodation are not included. In the event that more than one Participant achieves a Perfect Round, the Weekly Winner will be the Participant who has selected the Margin equal to or closest to but less than the actual Margin of the Margin Match of the Tipping Week in question. In the event that there is still a tie between Participants, the Participant who completed the Registration process first in time, will be declared the Weekly Perfect Round Winner. If no participant picks the Perfect Round the Weekly Prize will jackpot until it goes off. For Example, if there is no Participant who picks a perfect round for the NRL in rounds 1 and 2, but a Participant selects a perfect round in week 3, they will receive 6 tickets to the NRL Grand Final. If a Participant is, at the time of winning the Weekly Prize, a TAB Number 1 Club member, they will also receive one thousand (1000) Number 1 Club Reward Points as part of their Weekly Prize.

AFL ticket value: $210 per ticket
Total AFL value: $9,240


Major Prizes (both AFL and NRL)
Overall Winner: At the completion of the Regular Season, the Participants with the overall highest number of total points (calculated in accordance with the method set out above) in each of the NRL and AFL competition will be deemed the "Overall Winner".
The end of Season rankings for each Code will be determined:
a) firstly by the Participant's total Score for all Rounds;
b) then, in the case of a tie, by each Participant's Accumulative Margin for the Season;
c) then, where Participants have identical Scores and identical Accumulative Margins, the Participant with the lowest Round Margin for the last Round within the Season will be ranked highest; and
d) then, in the case of a further tie, the Participant who completed the Registration process the earliest will have the higher rank.
End of Season rankings will be determined no later than 72 hours after the final Round of the Season has been completed. In the case of Codes where a Prize(s) is/are awarded to Season place winners, the Prizes will be awarded to the Participants with the highest rankings.


The Overall Winner(s) will receive the respective first prize amounts detailed below.

The name of the overall winner ("Overall Winner") will appear on the Competition Website from Friday 10th September 2010 and published in the Australian newspaper on Monday 14th September 2010.
AFL Major Prizes:
1st Prize (the AFL "Overall Winner") $100,000 Cash payable by cheque

NRL Major Prizes:
1st Prize (the NRL "Overall Winner") $100,000 Cash payable by cheque
2nd Prize $5,000 Cash payable by cheque
3rd Prize $1,000 Cash payable by cheque


Total NRL & AFL Value: $212,000
Number one points value: $ 38,000
Total Prize Pool: $250,000


10. Local Store Prize - Limited to Participating TABs only:

Some participating TAB's in NSW and VIC will also be offering a local store prize ("Local Store Prize") which will be awarded to one of their customers who wins the Competition via the 'local league' function, which can be found on the Competition Website ("Local Store Competition"). The Local Store Prize is a prize to be determined by each participating TAB. TAB Agencies participating in the Local Store Competition will have an in-store leader board, which will be maintained over the course of the Competition Period by TAB staff. At the conclusion of the Competition Period the customer with the highest amount of points will be awarded the Local Store Prize. TAB Agencies participating in the Local Store Competition will be clearly marked in-store with signage. Ask at your local TAB if they are a participating agency.

11. Place and Time of Prize draws
The Weekly Prize Draws will take place between 8.00 - 9.00 a.m. each Wednesday of the Competition at the offices of TABCORP, 495 Harris Street, Ultimo NSW 2007.

The Major Prize Draw will take place immediately after the last Regular Season game for both NRL and AFL at the offices of TABCORP ,495 Harris Street, Ultimo NSW 2007.

12. Notification
Winners will be contacted by immediately after the relevant Prize draw. All Winners will be notified by email and will be published on the Promoter's Web Site upon determination and in the Australian Newspaper on the Wednesday following each respective Prize Draw.

13. Tax Statement
Any taxes which may be payable as a consequence of the winner receiving any of the Prizes are the sole responsibility of the Winner. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. Where the operation of this Competition results in, for GST purposes, supplies being made for non-monetary consideration, Participants agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market value.

14. Exclusion of Liability
To the extent permitted by law, the Promoter is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by the Promoter, or their servants or agents, in connection with this Competition or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to a Participant or the Prize Winner.

Prize Winners must sign and return any liability release provided by the Promoter as a condition of the Prize being awarded. Failure to return the signed release(s) will result in the entitlement to the Prize being forfeited and the selection of another Winner.

Nothing in these Conditions of Entry affects, nor is intended to affect, any rights a consumer might have which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servants or agents for breach of any such rights is limited to the supplying of the relevant goods or services again.

15. Unclaimed Prize Draw
If Prizes are not claimed within 3 months after the completion of the Competition, an unclaimed prize draw will be conducted at 10.00 a.m. on the 15th November 2010 at Tabcorp, 495 Harris Street Ultimo, Sydney subject to any written directions ("Unclaimed Prize Draw"). Winners of the unclaimed Prize Draw will be contacted by email and phone, and will be published in the Australian Newspaper on 20th November 2010.

16. General Conditions
The Promoter, its employees, officers, agents, and its parent companies and subsidiaries are not responsible for and shall not be liable for:

(i) any condition caused by events beyond the control of the Promoter that may cause the game to be disrupted or corrupted;
(ii) any injuries, losses (including, without limitation, loss of profits), or damages of any kind (even where resulting from negligence of TABCORP or any other person) caused by the prize or resulting from acceptance, possession, use, or misuse of the prize, or from participation in the game or downloading material from the website; or
(iii) any printing or typographical errors in any materials associated with the Promoter.


The Promoter reserves the right, in its sole discretion, to cancel or suspend the Competition, should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Promoter, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the game or to disqualify any Participant who engages in offensive, illegal or objectionable conduct. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process including but not limited to, techniques designed to avoid payment of call costs, or who submits an entry that is not in accordance with these Conditions of Entry. The Promoter also reserves the right to request Winners to provide proof of age, identity or proof of residency at the nominated prize delivery address.
Acceptance of any of the Prizes is deemed acceptance of these Conditions of Entry.
Winners can not exchange a Prize for cash or for any other Prize.

All Winners may be required by the Promoter in its absolute discretion to:

Participate in promotional activities for the benefit of the Promoter.
• That he or she will not, with out prior written consent of the Promoter (which maybe with held in its absolute discretion) participate in any other media activities, promotions for the purpose of or which involve discussion, commenting on, expressing a view on the account of the Competition. In promotional activities the Winner will refrain from expressing a negative or disparate view of the Promoter and its operations and related bodies.
• The Winner acknowledges and agrees that the Promoter has the right to all materials generated in connection with the Competition and can use the material in any medium and in any manner it sees fit.
• The Promoter will also hold the copyright to any photographs taken for publicity purposes and can use these photos in any promotional material for the time period of five years.

Notwithstanding any other condition of these Conditions of Entry, the Promoter reserves the right to cancel the Competition at any time and for any reason whatsoever. The Promoter also reserves the right to change any of the Prizes if the Prize is not available for any reason. The replacement prize would be of equal value as the replaced Prize.

If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the Competition.

In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.

The Promoter, its employees, officers, agents, and its parent companies and subsidiaries will not be responsible, and shall not be liable if any of the matches in the NRL or AFL regular season are cancelled, postponed, or in any way disrupted for any reason beyond the control of the Promoter, such as (without limitation) cancellation, postponement or disruption caused by an outbreak of equine influenza. In the event of a cancellation, postponement or disruption to any matches, the Promoter reserves the right to cancel the Competition without awarding any Prizes, or to modify the Competition as it sees fit. This decision will be at the sole discretion of the Promoter (subject to the requirements of any relevant regulatory body) and no correspondence will be entered into.

Programming and other quality control errors will not invalidate an otherwise valid Prize claim. Unless otherwise due to fraud or ineligibility under these Conditions of Entry, all valid Prize claims in excess of the advertised Prize pool will be honoured.

All entries become the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this Competition. The Promoter may disclose Participants' personal information to its contractors and agents to assist in conducting this Competition or communicating with Participants.

By entering the Competition, Participants consent to their personal information to be used by the Promoter, its agents, affiliates and business partners for marketing purposes. In doing so, the Promoter will comply with the Privacy Act

All entries become the property of the Promoter. The Promoter collects your personal information to assist us in providing the goods or services you have requested, to process your competition entries, and to improve our products and services. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. The Promoter or any of its Australian related companies, agents, affiliates or business partners may contact you by any means (including by SMS or e-mail) in the future for marketing purposes, including but not limited to advising you about goods, services or promotions which may be of interest to you. The Promoter may also share your information with other persons or entities who assist it in providing its services or running competitions or with other companies who provide prizes for competitions.

The Promoter accepts no responsibility for any loss incurred in the Competition that any or all of the scheduled matches are cancelled for any reason beyond the control of the Promoter.

The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any Prize/s except for any liability that cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

Decisions of the management of the Promoter are final. No correspondence will be entered into.

The Promoter reserves the right to refuse to allow a Winner to take part in any or all aspects of the Prize, if the Promoter determines, in their absolute discretion, that a Winner is not in the mental or physical condition necessary to be able to safely participate in the Prize. It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

To the extent that a situation or issue arises for which these Conditions of Entry make no provision or in relation to which the relevant Conditions of Entry are unclear, the Promoter also reserves the right to make a decision regarding such situation or issue in its sole and absolute discretion and such decision will be final and binding.

All entries become the property of the Promoter. The Promoter collects personal information about the entrant to enable the Participant to participate in this Competition and may, to facilitate the Participant's participation, disclose the Participant's personal information to other companies associated with this Competition. All Participants and Winners consent to the use of their name, suburb of residence and image for promotional and marketing purposes and agree to participate in reasonable promotional activities as requested by the Promoter. In doing so the Promoter will comply with relevant Privacy Laws.
